10% deposit and contingencies: Securing your investment.

Once the buyer’s offer, along with all agreed upon terms, has been accepted by the seller, we focus on helping the buyer select an accredited and certified property inspector in the area. The chosen home inspector performs a thorough examination of the property. If the inspection reveals no major problems and is satisfactory to the buyer, we immediately notify the seller that the buyer will waive the inspection and proceed with the purchase of the property. At this stage, the buyer must submit a deposit of 10% of the purchase price within 5 working days. This deposit serves as a substantial commitment, symbolizing that the property is now “UNDER CONTRACT”, effectively taking it off the market. The seller is no longer able to accept any additional offers on the property, even if they exceed the current offer in value.

Lake Chapala Realty then transfers all necessary documentation to the closing coordinator, who handles the closing due diligence process with meticulous care. Throughout this stage, our team remains steadfast in representing your best interests, ensuring a smooth closing process. Importantly, the seller will not receive the funds until the deed has been signed in the presence of the buyer’s chosen Notary. This prudent approach safeguards your investment and ensures a secure transaction.

The Closing

In Mexico, the transfer of ownership, legal documentation and Mexican deeds, better known as “Escritura” are overseen by certified Mexican Notaries appointed by the government. As a buyer, you are free to choose the Notary of your choice.

At Lake Chapala Realty, we understand the importance of a smooth and efficient closing process. With our extensive experience and track record of successful closings, we possess extensive knowledge of all aspects involved, providing unwavering support at every step. Our dedicated closing coordinator works closely with the selected notary, sellers and all parties involved to ensure a smooth and stress-free closing experience.

Collaboration with the Notary

We work directly with the Notary to facilitate a thorough examination of the property. The Notary’s responsibilities include reviewing the history of the property, obtaining certificates to confirm the absence of liens or debts from the public registry, verifying accurate measurements, and even requesting a certificate of absence of debts from the homeowner’s association (HOA) if the property is in a gated community. In Mexico, the notary assumes liability, which eliminates the need for title insurance.

Clear and transparent closing statements

We provide you with accurate closing statements that provide a transparent breakdown of the exact amount paid for the property, including any prorations received from the seller. These comprehensive statements ensure clarity and allow you to understand the financial aspects of the purchase.

Hassle-free bill transfers

Our team handles the paperwork necessary to transfer ownership of utility bills, including CFE electricity bills, TELMEX telephone bills and SIMAPA water bills, from the seller to you as the buyer. This process ensures a smooth transition of the utility bills into your name, and we personally handle these formalities at the local utility offices.

Peace of mind with severance letters

If the vendor employs people as maids or gardeners, we obtain severance letters for your peace of mind. These letters confirm that former staff members have received their entitlements, ensuring that you will not be liable for any future redundancy payments.

HOA Compliance

For properties within an HOA, we contact the board to obtain a no-debt letter necessary for closing. This letter assures you that the seller has paid all outstanding fees associated with the property, providing peace of mind and a smooth transition of ownership.

Diligent Verification of Deeds

During the closing process, we meticulously review and verify the accuracy of the deed information before all parties sign the deed. This thorough review ensures that all essential details are correct. Once the deed is signed, we release the funds to the seller, completing the transaction.
